ESOS (the Energy Savings Opportunity Scheme) is mandatory for large UK undertakings and their corporate groups. Qualifying companies who have not yet complied should act now, to avoid fines and civil penalties.

The scheme involves quantification and audits of energy used in buildings, industrial processes and transport to identify cost effective savings.

If approached correctly, participation in ESOS is an opportunity to cut operating costs and carbon emissions.

Act now to avoid fines

Companies that remain non-compliant with ESOS can ultimately face substantial ESOS fines and civil penalties.

If you qualify you should have notified the Environment Agency by 5 December 2015.

The enforcement process is now underway by a dedicated ESOS Enforcement Team since April 2016, to issue compliance and enforcement notices to non-compliant organisations.

ESOS FAQ

 

Who qualifies for ESOS?

You are mandated to comply with the ESOS regulations if on the qualification date of 31 December 2014 you are:

  1. A UK undertaking which has 250 or more employees in the UK or abroad.

  2. A UK undertaking which has fewer than 250 employees, but has:

    • An annual turnover exceeding €50m, and

    • A balance sheet exceeding €43m

  3. Part of a corporate group which includes a UK undertaking that meets criteria 1 or 2 above.

 

How do you comply with ESOS?

Compliance with ESOS is typically met via an ESOS compliant evidence pack, where you:

  1. Measure total energy consumption during a 12 month reference year across buildings, transport (freight and business travel in company and employees vehicles), and industrial activities

  2. Conduct energy audits to identify cost-effective energy efficiency recommendations, covering at least 90% of the total energy

  3. Have the ESOS assessment approved by an accredited ESOS Lead Assessor and reviewed by a board level director

  4. Notify the Environment Agency of your compliance

If you have an ISO 50001 certified Energy Management System, this also provides an alternative route to compliance.

 

What fines could you face?

Non-compliance with ESOS is subject to fines and civil penalties, and enforced by the Environment Agency’s ESOS Enforcement Team. Fines can reach £90,000 and are designed to increase for each day of non-compliance. Read more about ESOS fines here.

 

Do you have to implement energy savings?

There is no requirement to implement the identified energy savings in order to comply with ESOS.

However when working with Envantage, our experienced Chartered Energy Managers will typically identify simple efficiency improvements that will cut your energy bills at a zero or low investment cost.
