The Environment Agency is now writing to businesses who have not complied with the Energy Savings Opportunity Scheme (ESOS), indicating that they are at risk of enforcement action.
The statutory deadline for complying with ESOS was 5th December 2015.
A grace period may be granted to companies that notify the Environment Agency of their intent to comply, before ESOS fines are applied. In one example, a company has now been given a revised deadline of April 2016. They had indicated their intent to comply by 29 January 2016, and are now working with Envantage to meet the April deadline in order to avoid financial penalties.
Action should be taken now to reduce exposure to fines, as in the example above.
Non-compliant organisations who have not yet communicated with the Environment Agency about ESOS may face enforcement action sooner. Compliance and communication with the regulator is therefore recommended as soon as possible.
